ISSUANCE OF LICENSE TO BE SIMPLIFIED
“I”: What is the Licensing chamber’s plan to simplify the procedure of issuing a license?
Z. C.: From 2002 the number of documents, required for receiving a license was reduced three times. Then the Chamber underwent the regulatory reforms (“Guillotine”), which excluded the documents, which were not envisaged by the Law. That is why, the reduction in the number of documents and the de-bureaucratization is the stag, which we have already passed.
“I”: What are the most common reasons for refusing in granting a license?
Z. C.: In case of the construction – it is the fact, when economic entities assert that they hired specialists, but when our employees visit the spots, it clears out that in reality there is neither labor agreement, nor record service books. Some businessmen, who deal with the wholesale of alcoholic drinks, sell foodstuffs together with alcoholic Drinks. For seven months of 2007 the Chamber processed 2319 license applications, the Chamber refused to grant licenses to 215 candidates.
“I”: What is the license recall procedure?
Z. C.: The first method is the recall, when a violation is revealed. The Chamber sends an order to such economic entity within 15 days. It fixes the terms and specifies a Law and provision, on which basis the entity must make certain changes. If the entity does not fulfill the terms, he receives another order. If, no reaction follows in this case, the license is recalled. The second method is the immediate recall, when grand violations are revealed. It occurs in the case, when the entity submits one set of documents, but in the course of time the situation changes, it hired other people, but it did not re-registered the license. Six months after the license recall, the entity can submit a license application again. For seven months the Chamber made 479 orders.
“I”: How many licenses have been recalled from the beginning of 2007 and from which fields?
Z. C.: The Chamber recalled 193 licenses. Owing to our joint activities with the Ministry of Interior we recalled 31 licenses in the field of passenger conveyances. We recalled 23 licenses in the field of tourism, 19 – for the production of ethyl spirit and alcohol products, 18 – from loan-saving associations, 14 – for the construction. The lists of the recalled licenses are published in Monitorul oficial.
“I”: Will the free access to the All-republican license register be opened? What is the cost of making an extract from it? Z.C.: Only the state institutions have a free access to this register. An extract from the register costs 50 lei for ordinary citizens. We do not open an access to the register in order to avoid abuse, exclusion is made only for data on tourism and employment to prevent the illegal sending-off abroad.
“I”: In 2002 the Chamber registered about 5 thousand license holders, in 2007 – about 11 thousand. Does the increase in their number testify to the economy development?
Z. C.: When a big number of economic entities request licenses, it means that those, who had licenses, received a possibility to continue their work, their conditions were not worsened. An economic entity did not only continue its activities, but could receive a license for other types of services. And new economic entities began their economic activities that characterize the very economic climate.
“I”: In the elaboration of which project is the Licensing Chamber participating currently?
Z. C.: We offered a Bill, which envisages that only an application by an economic entity will be enough for receiving a license, so that the Chamber will receive an access to other institutions’ databases and will have a possibility to certify their authenticity. The Chamber will also be able to accept documents with their successive transfer to a respective organ for confirmation. The next stage is to present data in an electronic form, in this case it will not be necessary to keep files of documents for each entity. It should be noted that the Licensing Chamber was the initiator of the Law, which envisages a 50% discount on the government duty for granting licenses to economic entities, from the moment of whose registration not more than a year passed, and the government duty for rural drug stores was reduced from 2500 to 900 lei.
