TRANSNISTRIAN GOVERNMENT STANDS FOR EXTENDING STATUTE OF LIMITATIONS FOR DEBTORS ON COMMUNAL SERVICES

The statute of limitations for debtors on communal services will be extended to 5 from 3 years. This is provided in a draft law directed to the improvement of the situation in the unrecognized Transnistrian Moldovan republic (PMR) housing and communal services’ sector.

According to website of the region’s cabinet of ministers, deputy minister of economic development, head of the department for energy and communal services Alexander Goritsa explained the need of adopting such a law by the fact that around 20 thousand people have arrears on communal services in Transnistria as of today, while the very sum of consumers’ debts to suppliers exceeded 150 million rubles (9.3 million).

“According to the acting legislation, the energy supplying enterprises may recover the due funds through court only within three years. Moreover, before addressing to court they are obliged to apply the entire set of pre-court measures – to hand over a requirement to the debtor, to take a signature from him, to propose the debt repayment in installments and others. The procedure drags on, while three years later not even the court is able to recover the arrears. Given that enterprises, which are providing services to the population, owe money for electricity, heating, gas each other, these arrears never disappear”, he said.

According to him, for combating non-payers, other methods will be applied, for example the imposing of penalties and restriction on the services.

Chairman of the Transnistrian government explained that the situation in the field of communal services is very difficult, to put it mildly.

“The wear and tear of networks, infrastructure accounts for 70%-90%. In such a situation it is highly important to seek additional sources of financing investment programs. We do not raise tariffs for the population, thus we have to put maximum efforts in order that at least the money, billed to the population and legal persons, to timely come to the enterprises. If the situation remains as it is today, we will not have enough resources to transform these 70-90% of wear into at least 50-60% within 3-5 years to move away from the critical juncture”, he concluded.
