ENERGY COMMUNITIES SECRETARIAT COMPLAINS TO CABINET COUNCIL ON FAILURE BY MOLDOVA TO MEET EMISSIONS REQUIREMENTS

The Secretariat of the Energy Community sent a motivated request to the Council of Ministers against Moldova for not using the European legislation on emission control.

As is reported at the agency's website, the request was submitted after the preliminary dispute settlement procedure, which began in September 2018.

It was initiated due to the lack of transfer and implementation of the legislation regarding emissions from large combustion plants. The absence of national legislation in the field of environmental protection in Moldova in order to limit emissions into the atmosphere is a violation of the obligations of the Republic of Moldova under the Agreement on the Energy Community.

In its 2017 Implementation Report, the Secretariat has already asked the Moldovan authorities to take the necessary domestic legal actions without delay.

Obligations under the Large Waste Incinerators and Industrial Emissions Directives came into force on January 1 2018 for existing and new plants respectively.

The Council of Ministers will take a decision on alleged violations by the Energy Community in the field of the environment on the part of the Republic of Moldova after the submission of the opinion by the Advisory Committee.
