PREMIER ENERGY AND PREMIER ENERGY DISTRIBUTION MAY ADDRESS TO ECHR ON CAHUL CASE

27 march, 2020

Head of the Premier Energy representation in Moldova Jose Luis Gomez Pascual said that the company may address to the European Court of Human Rights for protecting its right to fair trial, if the position of the court on civil case in Cahul against the company does not change.

In an interview to the Banks & Finances Magazine, he reminded that a number of companies sued the Premier Energy and Premier Energy Distribution, demanding compensation worth over 14 million lei for poor quality delivery of electricity, which could led to a fire in a city trade center 8 years ago.

“In fact, these were boutiques with insignificant cost. In absence of strong evidences, in 2018 the court obliged the company to pay compensations worth over 12.5 million lei, but we categorically disagree with such a decision”, he said.

According to him, the company regards the court’s verdict as unlawful.

“The process of case consideration and the circumstances for the place of examination put under question the objectivity of court decision. This is why we do not believe in a fair trial”, he said.

According to him, the court ignores witnesses’ objections, company expertise.

“We disagree with how the judicial process is conducted. We are in a disadvantageous position, the preference is given to the other side, which has partner connections in the judiciary. Thus, I asked to transmit the case consideration into another court”, Jose Luis Gomez Pascual said.

The manager expressed regret that this address of the company, just as many other addresses, was ignored by the court.
