MoET HAS RECEIVED NO LEGISLATIVE PROPOSAL FROM PATENT HOLDERS

Chisinau. Business people, who act on the patent basis in the small business sphere, have not made any proposal on amending the legislation in this field, the last press release of the ministry says.
The ministry underscores the fact that a number of organizations under the disguise of defending the interests of patent holders and small businesses have put forward deliberately or not demands on amending the legislation only now during the period of the election campaign, when the legislative organ does not function.
The ministry would like to recall that in the first-half of 2008 together with patent holders from all the raions it worked out amendments to the Law on Business Patent of 1998, which envisaged the termination of all patent-based activities. As a result, on the basis of the patent holders’ proposals the Law, regulating patent-based business activities and the decision on the prolongation of the patent-based trade until 2017 were approved.
According to the data by the National Tax Inspectorate, as of June 1, 2008, 18.5 thousand people acted in Moldova on the business patent basis; as of June 1, their number constituted – 17.5 thousand. For five months of 2009 they transferred 11.4 million and 14.7 respectively to the state budget that accounted for 0.39% and 0.57% of the budget revenues.
As Infotag has already reported, the Association of Small Business of Moldova (ASBM) said on the eve that it will stage protest actions, if the Government does not support the small business by reducing considerably the taxes and dues on the patent-based activities. It remarked that the crisis exerts a destructive influence upon patent holders. Instead of encouraging small business enterprises the Government carries on mass inspections and raids, which usually result in extremely high penalties and the confiscation of goods in companies, at markets and routes. It aggravates the situation in the small business sphere. The association recommended the Government to expand the range of patent-based activities, to reduce dues and taxes, including the VAT.
