MOLDOVAN GOVERNMENT AGAIN ASKS EXPLANATIONS FROM CONSTITUTIONAL COURT

The Moldovan Government has once again addressed the Constitutional Court – this time to explain in which conditions the head of state may be suspended from his office and duties and who may perform the presidential duties in such instances.

The text of the inquiry to the Constitutional Court was approved at the Cabinet’s extraordinary meeting on Thursday, convoked to find a way out of the institutional crisis that has emerged due to President Dodon’s unwillingness to appoint Eugen Sturza minister of defense even after the candidate’s repeated nomination by the Prime Minister.

“We’ve found ourselves in a situation when the presidential duties have to be performed not during a certain period of time but for a concrete action – in this particular case, e.g., for appointing a minister of defense. Moldova is a parliamentary republic, and president may not provoke institutional crises or political instability”, Premier Filip stated at the government meeting.

As was already reported by Infotag, on September 12 the Prime Minister proposed to the head of state the candidacy of Eugen Sturza, a 32-year-old civilian, for the defense minister’s post, but the President declined it, stating that the defense sector has to be headed and directed by a real military professional, knowing the defense sphere inside out.

However, in response to the Government, the Constitutional Court ruled that if the president refuses to perform his constitutional duties, i.e. if he disagrees with the candidate nominated by the Government, his duties may be delegated to the Parliament Speaker or Prime Minister. For this, in each particular case it will be necessary to apply to the Constitutional Court, which must state the fact of non-fulfillment of official duties by the President and must delegate these plenary powers to the Speaker or Premier.
