NEW CONSTITUTIONAL COURT JUDGES SWORN IN ON FRIDAY

Moldova got a new Constitutional Court today. All the 6 judges have been sworn in on Friday in the Parliament in presence of president.

Earlier today, the Parliament appointed two of judges elected on the contest basis – Socialist MP Vladimir Turcan and ex-judge of the Chisinau Appeals Court Domnica Manole. These candidatures were voted by 54 MPs of the parliamentary majority.

“We regard both candidates as professionals and as able to work in interests of the Moldovan Constitution. They will be independent in the decision-making process and will not allow voluntarist approach to the Supreme Law”, Batrincea stated.

On Thursday, the Government appointed other two members of the CC – lawyer, Professor of the Faculty of Law in the Moldova State University Nicolae Rosca and CC consultant Liubov Sova.

In its turn, the Superior Council of Magistracy earlier appointed Sergiu Turcanu and Eduard Ababei to the CC.

The Constitutional Court has not been working for almost 2 months. The last decisions of the previous court were adopted on June 15, when the CC cancelled 6 of its disputable decisions dated June 7-9, that led to political crisis and factual diarchy in Moldova.

At the June 21 sitting, the Venice Commission of the Council of Europe declared the Moldovan CC decisions as hasty and contrary to the democracy norms. It concluded that the only way to rehabilitating constitutional stability is the resignation of all CC judges.

According to the legislation, six CC judges are appointed – two each from the Parliament, the Government and the SCM – for 6 years and are irremovable all along the mandate.
