CONSTITUTIONAL COURT CONFIRMS THAT ITS JUDGMENTS ARE FINAL AND WITHOUT APPEAL

The Constitutional Court of the Republic of Moldova has reaffirmed that its judgments are final and without appeal, and that this rule indeed applies to its decisions on appointing or dismissing CC Chairperson, reads the CC judgment made public on Thursday.

An inquiry concerning this question was lodged with the Court simultaneously by several Members of Parliament representing various factions who requested to clarify the situation around the entering in force of CC decisions, including those pertaining to the electing and dismissing of the Constitutional Court Chairperson.

“The Constitutional Court’s judgments are final. They come into effect at the moment of their approval, and are not subject to appeal. This pertains also to CC decisions on appointing and discharging the CC Chairperson”, Domnica Manole, the recently elected new Chairperson of the Constitutional Court, quoted the CC judgment text.

The inquiry was caused by the dismissal on April 23 of the previous CC Chairman Vladimir Turcan, and Domnica Manole was elected Chairperson shortly after that. In May, Vladimir Turcan challenged the CC decision with the court of general jurisdiction. So the deputies asked to explain the order of adoption and of entering into force of Constitutional Court decisions.
