PROMO-LEX MAINTAINS THAT CEC HAS EXCEEDED POWERS

The Promo-LEX Association believes that the Moldovan Central Election Commission exceeded its powers by having restricted political parties' participation in the presidential campaign. That was stated on Thursday by Promo-LEX Program Director Pavel Postica, who presented the 2nd Report of the Election Observation Mission covering the period of August 26 to September 15.

"We believe that political parties and voting blocs are election rivals - like are their presidential nominees, because, according to the law, the scope of their competence includes the registration and financing of initiative groups and the bearing of legal responsibility for mistakes and violations committed. Also, political parties receive funding from the country's State Budget and the size of this funding depends on the election results achieved by them or by their election candidates", said the expert.

Pavel Postica emphasized that the CEC order, pertaining to parties' financing of election campaigns, is causing a multitude of questions and suspicions because the Commission is not eligible to interpret the legislation.

Postica referred to Article 43 (7) of the Election Code stipulating that a party may remit to the electoral fund its own money that is available on the organization's bank account as on the beginning of an election campaign, including presidential campaign. He believes the CEC must cancel its order.
