CONSTITUTIONAL COURT STATES IT CANNOT RECOGNIZE PRESIDENTIAL ELECTION RESULTS PRIOR TO COMPLETION OF ALL ELECTION-RELATED LITIGATIONS

The Constitutional Court of the Republic of Moldova has stated it has no right to declare an official recognition of presidential election results before the completion of all litigations related to the polls.

The Court's press release was issued on Wednesday i.e. on the 10th day since the Central Election Commission had sent its election report and all law-stipulated accompanying documents to the CC.

The Constitutional Court made reference to Article 122 of the Election Code, according to which the Court issues its conclusion on correspondence or not correspondence of an election to the electoral legislation within 10 days upon receipt of documents from the CEC "but not before a final settlement by courts of all the complaints submitted [to the judicial instances] in conformity with law-stipulated procedures".

"As the courts have not yet settled finally all the election-related disputes, the Constitutional Court may not issue, so far, its judgment concerning the legitimacy of the presidential election", wrote the Constitutional Court.
