PRESIDENT APPLIES TO CONSTITUTIONAL COURT TO CLARIFY PLENARY POWERS OF TECHNICAL GOVERNMENT

On Monday, Moldovan President Maia Sandu applied to the Constitutional Court with questions related to the plenary powers of the so-called ‘technical government’ (government in retirement).

According to the presidential press service, the head of state “demanded to recognize as non-constitutional the provisions in the Law on the Government that pertain to the appointment of Acting Ministers exclusively from among the incumbent technical government, which has not been stipulated by the Constitution and may lead to upsetting the functioning of state institutions”.

Sandu’s inquiry pertains to the right of the President and of the government in retirement to make staff reshuffling, and whether or not the technical government is eligible – in exceptional cases – to sign international agreements.

“The Constitutional Court’s judgment on these questions should clarify the present-day situation, in which the country has found itself after the irresponsible actions by some parliamentarians, by the ex-president and former prime minister. The technical government must have the possibility to ensure country governance until the appointment of next government i.e. the possibility to make staff changes, to dismiss and appoint ministers”, believes President Maia Sandu.
