GOVERNMENT REGARDS DETENTION AND SUSPENSION OF ALEXANDER STOIANOGLO TO BE FULLY FOUNDED

23 september, 2022

The Moldovan Government is convinced that at the detention of Prosecutor General Alexander Stoianoglo and his suspension from office, there was no violation of the rights and freedoms guaranteed by the European Convention on Human Rights, maintains the Ministry of Justice, which sent to the European Court for Human Rights the Government’s remarks about the eligibility and essence of Stoianoglo’s petition against Moldova (No. 5281/22 and 19371/22).

Last June, the European Court for Human Rights requested the Moldovan Government to clarify on what grounds Stoianoglo was detained and placed under arrest, and whether there was evidence that the plaintiff could have committed the crimes he was accused of. The ECHR also wanted to know why the suspended Prosecutor General was banned from attending public meetings and talking to the press during the investigation.

The Government’s answer said that Stoianoglo was detained and placed under house arrest for apprehension lest he could have escaped from the investigation, interfere in the investigation or commit new crimes.

And about the ban on Stoianoglo's participation in events, the decision was taken in order “to ensure public order”.

Now the ECHR must notify Stoianoglo of the response it received from the authorities. He will have the possibility to provide his opinion on these matters.

Infotag's dossier: Stoianoglo was detained on October 5, 2021 on charges of corruption and abuse of office. Several criminal cases were initiated against him, which, after almost a year, have not been completed. The dismissed Prosecutor General was under house arrest, and now he is under judicial control. He does not plead guilty, considers the criminal case fabricated, and complained to the ECHR about the violation of his fundamental rights by the Moldovan authorities.
