GOVERNMENT LOSES IN ECHR ONCE AGAIN
Chisinau. The European Court of Human Rights examined the application lodged by Nicolae Malai, a national of the Republic of Moldova, who claimed that his human rights had been grossly violated by state officials, when in 2005 he was detained and accused of illegal fishing.
Malai’s lawyer Roman Zadoinov told a news conference in Infotag today that three years ago his client was detained when he was fishing peacefully at a lake near Orhei town.
“He was accused of illegal fishing, though Malai had on hands an official permission issued to him by the lake administration. Nevertheless, the court ruled to put him into custody for 30 days, which he spent in inhuman conditions. The jail cell had no WC, nor sewage, nor beds, nor chairs”, the lawyer said.
In his words, the ECHR arrived at a conclusion that the Government of Moldova had violated a whole number Nicolae Malai’s basic human rights, namely he was arrested without grounds, was kept in custody unlawfully and in inhuman detention conditions.
“For this, the European Court has ruled that the Government shall repay to my client €3,500 as compensation for the moral damage and €1,500 as costs”, said Roman Zadoinov.
To date, the European Court of Human Rights has already accepted 2,350 claims from Moldova citizens against their Government, and the plaintiffs have won an absolute majority of the cases. In 2008 alone, the Moldovan Government is supposed to repay €2.55 million in compensations against its defeats in the European court.
