NATIONAL PARTICIPATION COUNCIL SPEAKS AGAINST EXAMINATION OF 2014 STATE BUDGET LAW
The National Participation Council (NPC) has filed legal charges against the Moldovan Government, demanding that the court forbids the examination of the 2014 state budget draft law, at the Cabinet meeting today. Deputy President of the NPC, Antonita Fonari said at a news conference at Infotag today, that this request has been triggered by the lack of transparency in the Government’s decision-making process. “The 2014 state budget draft law has not been placed on the web site of the Government, three days against its examination and has not been publicly discussed,” she said. According to the coordinator of the NPC working group, Arcadie Barbarosie, many governmental documents may be contested in a court of law, because of the lack of transparency in the process of their adoption. “Why did we decide to sue at law the Government in case of the 2014 state budget law? because Moldovan citizens have been deprived of their legal right to know the situation regarding the main financial document of the country. We are not challenging with the court the draft law itself, but only its examination at the Cabinet meeting of November 27,” the expert said, stressing that the consideration of the draft law in the current conditions would be unlawful. He also said that transparency in the decision-making process is the basic principle of democracy. “Infringing on the principle of transparency, the Moldovan Government may adopt a decision that would not meet the interests of citizens. When the Moldovan authorities approved a Law on the Decision-making process, everyone thought that this was a right step. Unfortunately, the provisions of these law are not being observed,” said Barbarosie, noting that the Government is obliged to publish the draft decisions on its website, several days against their examination. The expert also recalled some recent resounding decisions taken by the Government, without observing the transparency principle. “I am talking about the privatization of Banca de Economii (ВЕМ) [Moldovan Savings Bank] and the concession of the Chisinau International Airport. These draft laws were included in the Government’s agenda only two hours before the Cabinet meeting. One can only suppose that they are being controlled by some groups of interest, which are also influencing the decisions of the Government,” said Barbarosie, stressing that the Moldovan society should exert some pressure on the Government, so as to make it observe the law, which is the basic principle of a rule-of-law state.
