EVENTIS MOBILE LAWYERS IN A STEP FROM LAWSUIT AGAINST MOLDOVAN STATE INSTITUTIONS “We are in a step from filling a lawsuit to the European Court against a number of state institutions from Moldova”, stated Serghei Gotonoga, Eventis Mobile lawyer and representative of the Iulerom Company.

 

On the Thursday press conference at Infotag he said that on July 18 he received the decision of the Chisinau Appeals Chamber, which confirms the obligatory enforcement of the contract on transferring to Iulerom the Eventis Mobile single property lot and license on providing mobile connection services.

 

“For more than a year we are in possession of the Appeals Chamber decision about necessity of transferring the property and license, but officials from Moldovan state institutions ignore it. The license is revoked, while the radio frequencies, which belong to us, are put for sale. We have warned the potential buyers that the transaction will be challenged, and if they decide the purchase, they will acquire problems”, explained Gotonoga.

 

He is sure that the “blatant disregard of the court decisions could not be possible without support of ordinary officials from the top of the power pyramid”.

 

“The Registration Chamber employees were recommended not to register the contract on purchasing the property lot Eventis Mobile by the Iulerom Company. The clerks in the National Telecommunications and Informatics Regulatory Agency (NARSI) have revoked the license and put the radio frequencies for sale”, said the lawyer, calling the situation “a classic raiding”.

 

The lawyer says that any attempts to obtain the execution of the requirements of Iulerom owners and Eventis Mobile are hampered by the reluctance to contact with lawyers.

 

“The decision of the Appeals Chamber have entered in force more than a year ago, according to which the new owner (Moldova’s third mobile communication operator) is ready to transfer 50 million lei, but is not allowed to use the property”, believes Gotonoga.

 

“We have possibility to return 20 million lei – the arrears of salaries to workers. People wait for this money. At least 10 million lei should come to the budget as taxes. But nobody needs this. Taking advantage of imperfections in system of court decisions execution, there is the division of our property, done behind our backs”, said the lawyer, drawing attention on the violation of the Article 120 of the Republic of Moldova Constitution, which provides that all the court decisions, which came in force, should be executed.
