LAWYER ILIE ROTARU CRITICIZES MOLDOVAN JUDICIAL SYSTEM Beautiful words about reform in the Moldovan judicial system have nothing in common with the reality, said lawyer Ilie Rotaru.

 

At the Wednesday press conference at Infotag, he said that “the country’s problem is not in policemen, who are accused of criminality growth, but in the corrupted prosecutors, who are often bringing to justice innocent people”.

 

As arguments, Rotaru cited the case of Stoianov family, whose head Valeriu was sentenced to 5 years for protecting his sister.

 

“She called Valeriu, when late at night her ex-husband came to her with a group of unknown. Valeriu came, but the unwanted guests did not let him into the house. He took the gun and fired several shots into the air and when the hooligans refused to obey, he wounded one of them in the leg”, said the prosecutor.

 

According to him, the court justified Stoianov, but the prosecutors, “who were most likely paid, challenged the court decision in the Appeals Chamber”.

 

“Judges from the Appeals Chamber broke the law and rendered unlawful verdict. Stoianov was sentenced to 5 years probation. Later, the Supreme Court of Justice sent this case for revision and this time the Appeals Chamber issued a new verdict – five years of imprisonment”, said Rotaru.

 

According to him, “former lawyers of the defendant’s family proposed to give bribe to judges and prosecutors, alluding that the second part has already made it”.

 

“During Communists times, around 25 thousand criminal cases have been started annually. Last year 38 thousand cases were initiated, and this is taking into account that judges are considering not more than 9 thousand cases per year. The rest of cases remain at the discretion of prosecutors, who are turning them upside down and nobody fights this lawlessness”, said the lawyer.

 

He said that he had repeatedly tried to get an audience with the Prosecutor General and the Supreme Court of Justice chairman, but with no results.

 

“Let the heads of these structures find out what their subordinates are doing. If they refuse, this means they now something and not far off is the day, when they will become accomplices. We boast before the Europeans that we take all the measures for the judicial reform, but this is not true. Unlike Moldova, in other countries there is an audit office for verifying cases, which already have a decision. If we have a similar body, it will stop lawlessness”, said he.
