ECHR RECOMMEND MOLDOVA TO ELIMINATE LAW VIOLATIONS AGAINST ANDREI BASTOVOI The European Court of Human Rights (ECHR) recommended the Moldovan Government to eliminate violations of the law, committed against Andrei Bastovoi and his son Valentin, announced lawyer Roman Zadoinov during Tuesday’s news conference at Infotag.

 

He reminded that Andrei and Valentin Bastovois are accused of causing damage to Ascom Company, due to which they were sentenced to 9 and 8 years, respectively.

 

“The decision of the primary court was imposed on December 21, 2013. They were immediately taken into custody, after which they started to serve term in a detention facility – penitentiary institution №13, despite the fact that the sentence did not enter into force. The court decision was immediately challenged in the Appeals Chamber. This is contrary to both international legislation and to the Republic of Moldova legislation”, said Zadoinov.

 

He specified inhuman conditions of detention, which are also a tough violation of human rights.

 

“In total we identified 27 human right violations, admitted by the primary court, the Appeals Chamber and the penitentiary institution. On these facts we addressed to the ECHR in February 2014. Taking into account all the conditions, the international practice allows doing this, despite the fact that there is no final sentence yet”, said the lawyer.

 

According to him, the application has been accepted by the ECHR, which, for a start, demanded from the Moldovan government to eliminate the committed violations in the case against Bastovoi.

 

“The ECHR gave the deadline (May 5, 2015) for stopping violations, to change the preventive measure, to pay compensation for the caused damage. We estimate this damage at 70 thousand euros for each – Andrei Bastovoi and Valentin Bastovoi” stressed Zadoinov.

 

Infotag’s dossier: On December 21, 2013, the Sectorul Buiucani court of Chisinau sentenced Andrei Bastovoi to 9 years, while his son Valentin – to 8 years. They are accused of causing damage in especially large amounts to the Ascom Company they had worked in. Another former Ascom employee – Ion Mescoi, was sentenced to 8 years on accusation of attempt to organize assassination of the Ascom leaders.
