LEX SCRIPTA INSTITUTE URGES PARLIAMENT TO REVISE SOME LAWS The Institute of Legislative Creativity Lex Scripta has called upon the ruling majority to revise the Laws on abolishing the parliamentary immunity, on appointment of the Prosecutor General and on decentralization, adopted by the Moldovan Parliament recently and already approved by the Constitutional Court.

 

Institute Chairman Mihai Corj stated at a news conference at Infotag on Wednesday that some provisions in the power decentralization law, passed on March 4, are at odds with the Constitution of the Republic of Moldova, so it is necessary to revise the document and improve it.

 

The Institute experts have analyzed the legislative initiative on amending the Constitution and arrived at a conclusion that the initiative is on the whole good, though contains some drawbacks. For instance the initiative reads that the Prosecutor General will be appointed by the President for 7 years, and in case of violations the Prosecutor General will be removed from the post by the President as well, but there is no provision about who will be performing the Prosecutor General’s duties until the appointment of a new Prosecutor.

 

Commenting on the Constitutional Court’s conclusion on abolishing parliamentary immunity, Mihai Corj said that there are technical errors in the document, but the Constitutional Court has somehow ignored them, and approved the document.

 

Constitutional Court ex-Judge Victor Puscas believes that the laws adopted recently by the Parliament and Okayed by the Constitutional Court need to be revised and improved, for it is only in such case that they will be really effective.

 

Commenting on the decision to abolish parliamentary immunity, Puscas remarked that parliamentarians submitted that initiative to the Constitutional Court on April 11, and already by April 18 everything had been fulfilled.

 

“By law, the consideration of such initiatives must take a much longer time, not just a few days”, said the former CC Judge.

 

The Institute-proposed remarks and recommendations will be sent to the Parliament and Constitutional Court Judges for consideration, it was said at the news conference.
