CC JUDGES MUST RESIGN – MIHAI CORJ
Judges from the Constitutional Court must recognize they made a mistake on June 7, when they took the decision on the expiry of term for forming Government, and must resign, maintains Chairman of the Lex-Scripta Law-Making Institute Mihai Corj. At a news conference at Infotag he said that he respects members of the CC, but they were wrong when they equaled the term of three months to 90 days. According to him, the Constitution separates the notion of “a month” from “30 days”, because it has articles where time frames are calculated with 30 and 60 days, as well as months. “It is unacceptable that the Parliament to adopt amendments on recalling the CC mandate. This will affect the CC independence. Despite the crisis situation, we must not go to extremes. Each has to recognize one’s mistakes and give to the state possibility to develop”, he maintains. Korj applauded Mihai Poalelungi’s decision to tender resignation from the post of CC Chairman. He said that the Parliament must change the legislation, establishing the age limit of 70 years old for CC judges. He maintains that the Article 85 of the Constitution “In case of inability to form a Government or in case of blocking law adoption for a period of over 3 months, the President has the right to dissolve parliament after consultations with parliamentary factions” must be changed – the phrase “has the right” must be substituted with “must”. Corj directed documents with amendments to the structures with the power to introduce legislation.
