SWINDLERS IN MOLDOVA TAKE AWAY BUSINESSES WITH JUDGES’ HELP – EXPERT CALDARE AND LAWYER URECHE Several criminal groups are operating in Moldova, which falsify litigations and, by using corrupt judges, take successful businesses away from citizens, said expert Igor Caldare and lawyer Denis Ureche at their Tuesday’s news conference at Infotag.

 

Caldare cited the story of Silvia Scobioala, the owner of the Free Fisheries Company well known in the country.

 

“On the basis of fabricated court decision about company’s alleged debt worth 1 million lei, a manager for business insolvency was imposed to it – Anatol Galdea. Scobioala returned the mythical debt in several days, but the story did not end here. Bailiff Cornelia Balan (Mr. Galdea’s wife) seized Scobioala’s property at a sum worth tens of millions of euros, while the very businesswoman was prohibited to leave the country”, said he.

 

Caldare said that when Scobioala was deprived of assets and property, she was not even summoned to the court hearing.

 

“As a person with experience and repeatedly beaten by life, she tries to fight though with not much success so far, because she is confronted by a system, adjusted by years of corruption and permissiveness”, said he.

 

According to Denis Ureche, on Tuesday a bailiff will visit another Chisinau merchant to confiscate from the latter 420 square meters of land in Chisinau downtown in favor of scams.

 

“These people managed to take a credit worth 1.5 million lei in one of Moldovan banks. They agreed with bank employees that they will use personal data of the businessman – owner of the land plot. This means both sides knew that they are deliberately going to commit an offence [the victim knew nothing about credit, taken on his name]. After getting money, swindlers spent this for personal purposes, and traditionally did not pay the loan. Later, the biased judges used obviously dubious documents when taking decision and adopted a verdict of confiscating the land. By the way, the cost of this land plot in Chisinau downtown is 3.5 million lei – a tidbit”, said Ureche.

 

According to lawyers, already not tens, but much more businessmen keep being trapped in criminal schemes of taking away businesses.

 

“People are threatened, blackmailed, broken. All this takes place with connivance of the government and its competent bodies. For example, the National Anti-Corruption Center is now considering actions of only one judge from the Sectorul Riscani court of Chisinau – Iurie Turcan [dismissed from function by the Supreme Magistracy Council], who is apparently involved in counterfeiting materials of criminal and civil cases and adopting deliberately illegal decisions. But he has colleagues in this ‘craft’. For example, in the Sectorul Centru court of Chisinau it is Ms Mazur, while in the Chisinau Appeals Chamber – Nicolai Craiu. Namely these officials, despite the allegedly existing computer system of random cases distribution to courts, were receiving cases on third-party claims on businesses. For example, Mazur is now considering four such cases at once. Does this seem to be an accident?”, wonders Caldare.

 

Human rights defenders addressed to the country’s authorities, urging them to counteract the lawlessness in Moldovan courts, as well as drew attention of Moldova’s foreign partners on the situation.
