MAIA SANDU TO PRESENT TO CONSTITUTIONAL COURT EVIDENCE OF ELECTORAL VIOLATIONS

02 december, 2016

Presidential ex-candidate Maia Sandu is preparing to present in the Constitutional Court her arguments and evidence of the violations and irregularities committed during the recent parliamentary election.

Sandu wrote in the social networks on Thursday that the day before the Supreme Court had declined her inquiry to this effect, having explained that violations of the Constitution and the Election Code are outside the scope of competence of courts of general jurisdiction and are in the exclusive competence of the Constitutional Court.

“In the course of the past presidential election, there were a lot of legislation violations that are casting doubt on the correctness of the election. As all the courts, which we addressed to, evaded examining those breaches of law, we shall address to the Constitutional Court where we will present proofs of the violations, which have undoubtedly influenced the election outcome and promoted the victory of the candidate of power [Dodon]”, said Maia Sandu.

As already reported by Infotag, the Constitutional Court has not yet set a date for approving the election results, though the law-stipulated 10-day period for result approval or rejection is expiring on December 1. However, the legislation stipulates that the result approval may only be made after general-jurisdiction courts have completed the consideration of all election-related disputes and claims. Besides this, earlier the Constitutional Court stated that the examination of electoral disputes and violations are in the scope of competence of general-jurisdiction courts, not of the Constitutional Court.
