CC DECISION IS IN LINE WITH LEGISLATION – LDPM FACTION LEADER

The Constitutional Court was guided by the law at considering and deciding on Government’s request on the order of minister’s appointment, maintains Chairman of the parliamentary faction of the Liberal Democratic Party of Moldova Tudor Deliu.

At the Wednesday’s press conference in the parliament building he said that the President has no right to impose veto on candidate for the post of minister, there is a procedure according to which the Premier is nominating candidature, while President can decline it once, but is obliged to promulgate it in the second time.

“I adhere to the principle: Dura lex, sed lex – the law is hard but it is the law. We can even say: the law is bad but it is the law. In the current situation in Moldova, one should not play games. President cannot block a candidature only because he wants this”, Deliu said.

The MP maintains that the CC decision is the first step to President Igor Dodon’s resigning, as the Constitution implies that the head of the state may be dismissed if he admits flagrant violations of Constitution provisions.

“Yesterday, the Constitutional Court decided that the President violated the Constitution and did this purposefully. In such a situation, the legislation implies that for dismissal, a draft law is necessary that would be signed by at least one-third of MPs, after which the initiative is proposed for consideration in the Parliament. With the parliamentary approval, the procedure of conducting referendum on dismissing the head of the state should start within 30 days”, he explained.

According to him, after the CC has pronounced, the ball is on the side of the Parliament.
