SCJ DECLINES ANDREI NASTASE'S APPEAL, RECOMMENDING HIM TO ADDRESS TO APPEALS COURT

The Superior Court of Justice declined the appeal of "Demnitate si Adevar" [DA, "Dignity and Justice"] Party leader Andrei Nastase on revising the decision on invalidation the results of Chisinau mayoral election. On Tuesday, the SCJ recommended to the lawyer to address to the Appeals Court.

Last week, lawyer Dumitru Pavel addressed to the SCJ on behalf of Andrei Nastase. He justified the application by the fact that new circumstances occurred in the case on elections, which were not known as of the moment of the trial. He reminded that during the case consideration Andrei Nastase demanded court panel challenging. This application was considered and declined by judge Iuliana Oprea, who reached 65-year age limit for stay in the post of judge.

According to the lawyer, this context may serve as basis for revising the verdict on challenging three judges. Of course, the judges recognized that lawyers' requirement is justified. Several days after the issuing of the verdict Iuliana Oprea retired. Last week, the Parliament approved her resignation from the post of judge.

However, the SCJ came to a conclusion that it cannot revise its own decision in this regard, recommending Nastase to address to the Appeals Court.

"Of course, this is nonsense. But we will address to the Appeals Court immediately after we get the SCJ motivational part of the decision", Dumitru Pavel said.
