CC JUDGE DEMANDS CANCELING THE DECISION ON APPOINTING COURT CHAIRMAN

Judge of the Constitutional Court Domnica Manole demands to cancel the decision on appointing Vladimir Turcan as Chairman of the Court. She said to journalists on Tuesday that she wrote an address to the CC with the demand to revise the adopted decision, though she was among those who voted for this decision.

At the same time, Manole said that the status of a judge does not allow her making other comments, or tell how she voted during the secret ballot.

“I wish I could tell you, but there is such a notion as the secrecy of discussions and voting I have no right to break. The disclosure of the secrecy of discussions and voting may be punished with recalling of the mandate, according to the article 18 of the Law on the Constitutional Court. All I can tell is that the voting was secret”, Manole responded to the ACUM leaders’ demands to disclose the details of the voting.

On Monday, Constitutional Court judge Liubov Sova said that the election of Vladimir Turcan as Chairman of the court was planned and that the voting is the result of the previously adopted decision, She said that before the voting she received a message from a parliament employee with the proposal to nominate Vladimir Turcan for the post of CC judge. She refused and nominated Sergiu Turcanu for this post.

“He removed his candidature and said he is not ready to become Chairman of the Court. Domnica Manole and Eduard Ababii did the same. Sergiu Turcan proposed my candidature. I suppose that he voted for me. I also voted for myself. This means that the rest of judges voted for electing Turcan, The results of the voting were 4 – for Turcan, two – for me. I risk losing my post of judge as I disclosed the results of secret ballot. However, I maintain that the public interest is above these risks”, Sova said.

Vladimir Turcan said that his appointment was based on the law and that criticism is a result of emotions which will soon calm down.
