CONSTITUTIONAL COURT GIVES POSITIVE OPINION ON HOLDING REFERENDUM ON EUROPEAN INTEGRATION

The Constitutional Court has given a positive opinion on the draft amendments to the Basic Law on European integration. Now the Parliament can consider the issue of setting the date of the referendum with the question specified in the draft law.

A group of 46 MPs from the ruling Party of Action and Solidarity (PAS) has submitted a request to the Court. The Court recognized that the initiative complies with the Constitution, including the limits of its revision.

The referendum will ask the question: "Do you support Moldova's accession to the European Union?." According to the initiative, the referendum is to be held on October 20.

According to the draft law, two phrases "reaffirming the European identity of the Moldovan people" and "declaring European integration as a strategic goal of Moldova" are added to the preamble of the Constitution.

The Constitution will also be supplemented with a new section - "European integration". It will include an article "on accession to the constituent treaties and acts on the revision of the constituent treaties of the European Union." According to this article, "the accession of the Republic of Moldova to the constituent treaties of the European Union, as well as the accession to the acts on the revision of the constituent treaties of the European Union shall be established by the Parliament by an organic law."

The article also stipulates that "after accession to the EU founding treaties, as well as to other binding Community regulations, these provisions shall take precedence over contradictory provisions of domestic laws, while respecting the provisions of the accession act."

Earlier, parliament adopted amendments to the Electoral Code to allow the referendum to be held on the same day as the presidential election.
