THREE MOLDOVANS RECEIVE COMPENSATION FROM GOVERNMENT FOR IMPROPER DETENTION CONDITIONS

21 octomber, 2016

The Moldovan Government has avoided punishment from the side of the European Court of Human Rights (ECHR), repaying to three citizens 3 thousand euros each as compensation for improper detention condition and legal protection.

According to lawyer Vitalie Zama of the organization “Lawyers for Human Rights”, Veaceslav Murzacov, Timofei Sulac and Vladimir Aga, detained by police in 2015, addressed to the Strasbourg court with the complaint about breaking two articles of the European Convention for Human Rights. The court accepted their complaint for consideration and informed the Moldovan Government about this.

“The Government recognized the violations and undertook to repay to plaintiffs the compensation for moral damage. After such settlement of the conflict, the consideration of the case in the ECHR has been stopped”, he said.

Also, spouses Leonid and Anna Nicolas addressed to the ECHR with a complaint that their son died as a result of cruel treatment during his detention.

In 2006, the young man refused to come to the police station, for which he was detained and sentenced to three days of administrative arrest. During sentence serving, he felt bad and was hospitalized. Doctors found that he had alcoholic delirium and a number of chronic diseases. Despite doctors’ efforts, the young man died in the hospital.

“Independent experts did not find signs of beating on the man’s and the ECHR stopped the consideration of the complaint, as it did not get convincing proofs of cruel treatment. Instead, it recommended the plaintiffs to sue the hospital which was providing assistance to their son”, the lawyer said.
